Students must demonstrate the ability to identify, assemble, and Research Paper

Students must demonstrate the ability to identify, assemble, and disseminate extant information relating to a topic in - Research Paper Example 205). Majority of Americans, whether supporters of the Republicans, the Democrats or Independent candidates, have repeatedly put into perspective the religious beliefs, values, and principles of political contenders in the run up to the country’s elections. For instance, religious affiliations of Abraham Lincoln, Thomas Jefferson, Bill Clinton, George Bush, John F. Kennedy, William Howard, Ronald Reagan, and Barrack Obama among others played significant part in view of their chances to clinch the presidency. While most of these candidates were purportedly Christians going by the official membership, American electorates also considered a number of them Muslims, deists, or even atheists (Newport, p. 205). In essence, religious affiliations always became subject of scrutiny and criticism during political campaigns and had significant impact in the candidate’s ability to articulate his plans and schema for the country and citizens. Controversies that surrounded Mitt Romney ’s religious affiliations played a role in his shocking loss to President Obama. Review of Literature Religious affiliations of political candidates have boosted or narrowed down their chances to clinch the presidency and other political positions in the United States. ... Even political parties have been subject of scrutiny as far as religion is concerned. In essence, most allegations lack substantial proof and attestation. Various scholars have attested to the issue of religious belief and affiliation especially during campaign periods in America. According to Fisher and Koch (2004, p. 62), Roman Catholics emerged as the most preferred religious affiliation by most presidents. However, their book The Entrepreneurial College President, indicate a huge disparity in terms of the chances that a Roman Catholic presidential candidate has to become an effective president of the Unites States. Hence, there is serious underrepresentation of the Roman Catholics by considering the number of effective presidents they ever produced since the country attained its political independence. In their analysis, a meager 24.5 percent indicated preference for a Roman Catholic president (Fisher & Koch, p. 62). The trend is more shocking when one considers the Baptist presi dential representation. Apparently, Americans who subscribe to the Baptist denomination constitute a skimpy 16.3 percent of the entire population. The mainstream Protestant denominations such as the Lutheran, the Methodist, and Presbyterian are surprisingly overrepresented despite their minimal frequency in the entire country’s population. According to Fischer and James, the Presbyterian Church constitutes less than 3 percent (precisely 2.7 percent) yet it enjoys massive representation in the overall presidency outlook (Fisher & Koch, p. 62). However, the study indicated no preference for a Muslim president notwithstanding realism of the religion constituting a significant percentage of the

Paragraph - Essay Example more, the authors also emphasize that the number of individuals that develop diabetes would mean an increase in government expenses to fight the disease. Moreover, Cresswell states that there are 275 Australians who develop diabetes per day, which matches Robotham’s statement that 100,000 Australians develop diabetes annually. While both Cresswell’s and Robotham’s articles have many similarities, they also have some differences. First, Cresswell discusses in his article a study in 1999 to 2000 involving 11, 247 participants while Robotham did not mention this at all. Second, Cresswell also mentions that aside from the 275 individuals who develop diabetes daily, there are already one millions Australians who have the disease. Robotham does not mention this in her article either. Third, Cresswell again is very specific when he writes that the government expenses in fighting diabetes would cost around $3 billion annually, while Robotham merely says that the diabetes epidemic will have a big impact on the government’s health budget. Finally, Cresswell states that 25% of schoolchildren are already overweight, while Robotham mentions that younger individuals gain weight faster than middle age adults

The Evolution Of Telemedicine Health And Social Care Essay

The Evolution Of Telemedicine Health And Social Care Essay Who would have ever imagined that a doctors visit could be conducted through a phone-line, video, or the use of a computer 1000 plus miles away? Medical records can be view by another medical professional for a second opinion three counties away before you arrive. A radiologist in Singapore has diagnosis your femur fracture here in the United States. Medical diagnosis, treatment and consultations are being performed from miles away because of technology. It seems as if there is no limitation to the well being of a patient through a wide range of telemedicine services. What is telemedicine? According to the American Telemedicine Association telemedicine is the use of medical information exchanged from one site to another via electronic communications to improve patients health status. Emails, videoconferencing, transmission of still images, e-health including patient portals, remote monitoring of vital signs, continuing medical education and nursing call centers are all considered part of telemedicine.(http://www.americantelemed.org) This interactive form of medical services has provided healthcare to individuals many miles away or minutes away in the comfort of their homes, physician offices and hospitals. Ways to communicate services Store-and -forward is a means of transmission of medical information to other medical professionals and facilities that will provide the recipient pertinent medical history, vital signs, medical records, lab results and images. Store-and-forward telemedicine systems have the ability to capture and store digital still or moving images of patients, as well as audio and text data. A store-and-forward system eliminates the need for the patient and the clinician to be available at the same time and place. Store-and-forward is therefore an asynchronous, no interactive form of telemedicine. It is usually employed as a clinical consultation (as opposed to an office or hospital visit). (http://www.ahrq.gov) One of the major concerns with store and forward is whether it is as effective as face to face medical visits, does it have comparable outcomes, is it appropriate for appropriate medical management, is the patient truly satisfied with the outcome and level of services and is it cost effect ive? There are several benefits of store-and-forward technology. Patients in rural areas are able to be seen by specialty physician miles away when there is limited access to the services in the area. The store-and-forward of medical information is also being used with emergency response teams to communicate the information to the emergency room staff for an efficient transfer of vitals and medical status. The store and forward technology is said to be the least expensive way to communicate and the most accurate in real time for patients at a distance needing medical consultation. Another type of store and forward technology is videoconferencing technology. The two way television allows two doctors in two different areas to communicate to provide treatment, a diagnosis, or telesurgery. There are several healthcare areas that benefit from telemedicine Some of the common teleservices Telemedicine includes several medical disciplines that benefit from the services. Services like radiology, dermatology, nursing, pharmacy, pathology, neurology and psychiatry. The need for a second opinion in healthcare has seen a demand, and the shortage of specialty doctors in rural areas increased. The development of telemedicine has benefited the patient in many ways because of technology. Teleradiology- is the transmission of x-ray, CT, MRI, PET, and SPEC images that can be read by radiologist in another facility or country. The information is sent via the store and forward process of telemedicine. Large and small hospitals have began to use teleradiolgist to cut down on expense and having access to immediate diagnosis. Teledermatology- is the use of video conferencing and store and forward images to provide a consultation for an individual that requires a dermatologist. There have been concerns with the consistency of this tyoe of visit for patients due to unclear images of the skin and the possibility of not having that face to face visual from the dermatologist to make an adequate diagnosis. Telenurse- the use of phone, electronic email, videoconferencing, and computers to provide healthcare services or consultation to a patient. Telenusring has continued to grow in the areas of telephone triage for health insurance carriers. Telenursing has grown with interactive patient training related to changing wound dressings, insulin administering, self management of a patients health. Reimbursement Many of the healthcare providers must follow certain guidelines to receive payment for telemedicine. According to Medicare its condition for payment must include an interactive audio and video telecommunications system that is used and must permit real-time communication between the physician or practitioner at the distant site and the beneficiary at the originating site. The medical providers that are covered under this fee for payment are services rendered by a physician, nurse, physician assistant, midwife, clinical nurse specialist, or clinical psychologist. The current list of Medicare telehealth services includes: Consultations Office or other outpatient visits Individual psychotherapy Pharmacologic management Psychiatric diagnostic interview examination End-Stage Renal Disease (ESRD)-related services Neurobehavioral status examination For ESRD-related services, at least one face-to-face, hands on visit (not telehealth) must be furnished each month to examine the vascular access site by a physician, NP, PA, or CNS. (http://www.cms.hhs.gov) New Trends in telemedicine Trends observed nationally include: using telemedicine in correctional facilities and home health care settings, can significantly reduce the time and costs of patient transportation; providing additional services to rural area linking physicians together more efficiently linking hospitals and schools together to improve care and widespread The benefits With a growing population and healthcare on the rise many public and private medical providers have seen a cost reduction with the use of telemedicine and patients have benefited from the technology in telemedicine. Insurance providers are paying for less hospital in patient days because the patient can be monitored from a distance. The patients are able to communicate with a nurse or physician at home through phone, video, or Bluetooth monitoring. Telemedicine allows more freedom to the patient to feel less restricted to home visits, they have access to some providers 24 hours a day and it cuts down on their travel time to medical visits. The patients family has also displayed satisfaction from the use of telemedicine because its less strenuous on their travel time and loss of work days. Another benefit of telemedicine provides an outreach to rural areas to be included in clinical trial studies and procedures. The providers have also benefited because they are able to receive real t ime feedback from other professionals that are able to transmitted medical information quickly, decreased travel time, and continued patient education and communication. Issues that need to be addressed Education regarding telemedicine and its usage. There are concerns that many do not know that he services exist. Cost and evaluation of the services. Will the cost for reimbursement be lower because there is no face to face contact? How will the affects of technology increase cost? Liability and malpractice issues. Out of state practices of medical professionals crossing their licensed boundaries. How will they be regulated and which state laws and rules will they be governed under? Security is always a concern regarding information sent via phone and internet lines. Can medical information be protected properly and the doctors will be held liable for the misappropriation of a patients medical information. Although there are HIPPA laws regarding patients privacy according to ORTCC its much more difficult to guarantee confidentiality because several individuals outside the traditional medical team. The transmission procedure requires technical staff at both ends. In small communities, it is possible that the patient knows the nonmedical personnel socially, compounding the sense of loss of privacy. Thus, the nature of the doctor patient relationship changes dramatically with telemedicine, challenging traditional concepts of privacy and confidentiality. (http://www.ortcc.org) Conclusion With technology making waves telemedicine has been able to grow through leaps and bounds allowing those that are limited and restricted to receive the medical attention of medical professionals. Physician has gain quicker access to other professionals without sitting face to face, digital images, and audio files of heartbeats and fetal movements. The privacy, protection, reimbursement, malpractice, and governing laws are still a concern but the efficiency of communication to provide medical care is needed.

B. F. Skinner Essays -- essays research papers

B. F. Skinner Burris Frederic Skinner was born on March 20th, 1904 in Susquehanna, Pennsylvania. His mother, Grace M. Burrhus, was a stenographer and a secretary, in a law office and later in a railroad chief executive's office. His father, William A. Skinner, was an attorney, who studied law with another local attorney at a New York Law School. Skinner's parents were both good students. His father had bought several sets of books, so there was a lot of reading material their children. Skinner said that his parents never used physical punishment, except for the time they washed his mouth out with soap for bad language. (Ulrich, 1997) B. F. Skinner was very adventurous child. He lead a 300 mile canoe trip down the Susquehanna River when he was only 13 years old. He was a natural inventor and he loved build things. One of his inventions included a device that automatically reminded him to hang up his pajamas in the morning. He played the saxophone in a jazz band during high school and played piano until his failing eyesight made it hard for him to read the music. In college, he was very independent, and sometimes even a prankster. He graduated from Hamilton College in 1926 and later received his P.h.D. in psychology at Harvard University. (Ulrich, 1997) John B. Watson John Broadus Watson was born in Greenville, South Carolina on January 9th 1878. He went to college at Furman University and the University of Chicago. Watson created "Psychological behaviorism" in 1912. He told the world about his theory of behaviorism in a 1913 paper entitled ``Psychology as the Behaviorist Views It.'' In the paper he described Behaviorism as the part of psychology that shows behavior as "a series of observable movements in time and space". (Turner, 1997) He rejected both conscious and unconscious mental activities and defined behavior as a response to a stimulus. A few of John B. Watson's literary works include the following books and papers: Animal Education, Behavior, Psychology from the Standpoint of a Behaviorist, Behaviorism, and Psychological Care of Infant and Child. (Turner, 1997) Along with his own theories of behaviorism, Skinner developed the theory of operant conditioning. Operant conditioning is based on the idea that "we behave the way we do because this kind of behavior has ... ...duces the stimulus."(Skinner, 1938) For Skinner's Behaviorism Page 7 example, Skinners cat tries to remove his flea collar because it irritates his sensitive skin. Skinner removes the collar from the cat as a form of negative reinforcement. (Skinner, 1938) In his time, B. F. Skinner attempted to make a lot of changes in modern psychology. Made people didn't agree with his changes because he didn't think that psychology had to do with feels or emotions. He felt that psychology had suffered in the past because it tried to explain human behavior in terms of feelings and states of mind. Skinner thought that psychology had wasted a lot of time making theories about the mind and personality. He suggested that psychology should only deal with behavior that is "observable in the world in which it occurs." (Henderson, 1990) In conclusion, B. F. Skinner was a very intelligent man that viewed behavior as "a response to a stimulus." Though he may have based his theories mostly on animal testing and he many have even portrayed man as a being without feelings, creativity, or morality, he was truly great and saw behaviorism like no one had seen it before. (Skinner, 1938)

Compare and Contrast role model: Richard Dawkins Essay

When choosing a role model according to my Christian worldview there are several positions taken into account. Their position and belief on Sexuality, Social Issues, and the Nature of God are areas in which our agreeing or disagreeing is a major contributing factor throughout the decision making process. Because of our foundational beliefs, Richard Dawkins does not meet the most lenient of qualifications according to my Christian worldview in order to serve as a role model. According to my Christian worldview a role model can be defined as a person whose belief system being based upon their acceptance that God is the creator of the universe, has sent his only begotten Son as the sacrifice for sin, and trusting the Holy scriptures are the inerrant and infallible word of God. Richard Dawkins once stated, Genetic engineering is important for the future of the human species and that our emerging technology of altering certain human cells will affect individual gene pool in order to dictate human behavior and gender (Harris, 1984). This statement implies humankind posses the knowledge of what it takes to create a person and to determine their sexual behavior outside of the Christian worldview. In believing human behavior has a genetic basis whereby altering specific genes we can create individual as we see fit is the very premises that Adolf Hitler used when attempting to create a master race. Professor Dawkins believes the possibility of engineering human being exist where my Christian worldview says, biblical scriptures provide the necessary truth on God not only creating humankind but also that Gods Holy Spirit will affect human behavior without gene manipulation. The Christian worldview beliefs on sexual behavior differ from Professor Dawkins suggesting it is genetically based. Christianity teaches, humanity was created in the image of God (Genesis 1:26), God determines the gender of a child, and God has the ability to change the deviant behavior of people. As I continued efforts towards invalidating Richard Dawkins as a possible role model his questionable stance on abortion came to mind as I read an article entitled â€Å"Abortion and Dawkins’ Fallacious Account of the So-called ‘Great Beethoven Fallacy’. The article discussed Professor Dawkins ethical and moral understanding on abortion as it relates to the Great Beethoven Fallacy and religion. Though he bible does not speak about aborting a child directly, scripture does make a distinction between killing as a result of an act of God and killing as a result of premeditation (Exodus 21:12). Christianity foundational belief in Jesus and the teachings of Jesus stands against all forms and efforts to stop procreation among humankind. God while speaking words of encouragement to Jeremiah says, â€Å"Before you were in the belly I formed you and before you came out I gave you purpose or a reason for living† (Jeremiah 1:5). In other words, the Christian worldview stands against supporting abortion or any form of human population control efforts that cause the death of Gods children. Professor Dawkins opinion differs from a person sharing in the Christian worldview by claiming, â€Å"The measuring stick for abortion is the suffering of the fetus (McLachlan, 2009). Professor Dawkins proposing questions such as â€Å"Does the pregnant woman or the family suffer† is immaterial when God identifies with the fetus before the birthing process begins. In addition to the fetus or the family suffering in respect to aborting the child, consideration was also placed on the mental aspects of the family. For instance, terminating pregnancy due to psychological issues, health of parents or number of children could also be a deciding factor in aborting the child. The final area used to rule out the possibility of Professor Dawkins serving as a role model for me or anyone with a Christian worldview was his foundational belief concerning the existence and nature of God. Professor Dawkins book entitled The God Delusion, characterization of God in saying, â€Å"The God of the Old Testament is arguably the most unpleasant character in all fiction jealous and proud of it; a petty, unjust, unforgiving control-freak, a vindictive, bloodthirsty ethnic cleanser; a misogymstic, homophobic, racist, infanticidal, genocidal, fihcidal, pestilential, megalomamacal, sadomasochistic, capriciously malevolent bully (Baker, 2009, p. 75). † During his childlike rant Dawkins proved, he was incapable of serving as a role model to anyone whose foundational belief was Christianity. By questioning Gods absolute authority, Dawkins implied God was unable to judge humankind righteously. A person with a limited understanding of scripture yet posses the Christian worldview may feel challenged as they read Dawkins statement of God as being jealous. In all actuality the Biblical scriptures contained in the book of Exodus speaks of God being jealous but not in the context of Professor Dawkins statement. By definition, Dawkins reasoning meant someone that is envious of another because of his or her achievements and advantages. The difference in Dawkins definition of jealousy and the Holy Scripture is in the interpretation of Exodus 20:5, which does not pertain to the sin of jealously but rather the act of giving someone else something (Worship) that only belongs to God. In closing, Professor Richard Dawkins is not a person I would choose to be a role model based on the following facts, his belief that gene manipulation will determine the outcome of human behavior as compared to my believing God created us individually without gene manipulation. Professor Dawkins stance for supporting abortion says the measuring stick should be the suffering of the fetus, mother and father, as compared to my believing God identifies with us before we are formed in the mother’s womb. Finally, the argument that nullifies any chance that Professor Dawkins meet the qualification of serving as my role model was his characterizing God as having the same sinful nature of humanity.

Caledonia Products Essay

There are a lot of factors that Caledonia must consider when they are thinking about buying versus leasing a property. Leasing brings many positive savings in a company; there are many incidentals that may come up while owning a property, such as the unexpected repairs. Leasing can help with long term savings for a company; it provides the comfort of trying new areas out. If Caledonia starts to branch out, opens up new locations in different states, leasing the building will be a lot smarter of an idea than it would be to buy. Not knowing how well the company will do in that state, will provide tons of savings if things do not go as planned. Along with saving during the long term, Caledonia will be saving in overall taxes. However, if Caledonia has owned a previous leasing site and business is moving. It will be smart for them to go ahead and buy some property. They will be able to save in the long run with owning instead of leasing, because this location will be considered a long term. While owning the site, doing renovations to the building will never be an issue. You will not have to go through the hassle of a third party to the store/ property up to standards to the market. There is already a process with getting permits pulled and getting construction sites up to code. Depending on the overall move that Caledonia wants to go in will have to be based off of their initial plan on getting more property. As mentioned there are many different pro’s and con’s on why either leasing or buying can be considered an option.

Complete List of IB Schools in the USA, by State

Complete List of IB Schools in the USA, by State SAT / ACT Prep Online Guides and Tips As a former IB student, I highly recommend the IB Diploma Programme. I think I was far better prepared for college than my non-IB counterparts. I had been prepared to think critically and globally. If you are a parent or student interested in enrolling in an IB Diploma Programme, this article is for you. I've compiled a list of all the IB Diploma Programme Schools in the United States and arranged them by State. I have also provided several of the school’s Diploma Rate. The Diploma Rate is determined by the percentage of the students who receive IB diplomas out of those who were diploma candidates. Not all students who pursue an IB Diploma will receive the degree; you must complete certain qualification (achieve certain test scores and complete certain projects to a satisfactory level). For more information on this, check out our other article, What is the IB Program? And What are IB Classes? How to Use This Information First and foremost, you should use this information to locate the IB Diploma Programme School nearest you. If you are lucky enough to have a couple of IB Diploma Programme Schools in your area or if you are simply trying to decide between an IB and non-IB schools, then you should compare the two using a couple of data points. What Questions Should I Ask When Comparing IB Schools or an IB and Non-IB School? If you are comparing two or more IB Diploma Programme Schools (or an IB School with a non-IB School), I recommend emailing the IB coordinator at each school (you can contact them through the school’s hyperlink below) and asking for: The school’s IB Diploma Rate (mentioned above, but again, this is the number of students who received IB Diploma out of all of the IB Diploma candidates at that school) However, this should not be the be all end all. According to one IB coordinator, â€Å"IB allows schools to not count some students’ scores, so the school will not drop the student in order to help their percentage.† So, the rate may not be reflective of the whole school’s performance. What is the admission criteria for their IB Programme (usually it differs from the High School’s overall admission criteria) The overall graduation rate How many graduates are headed to 4-year schools You should also look at how long they have been an IB School (the older school’s tend to have better teachers and Diploma Rates) You can find this information on the IBO school page (simply click the hyperlinked school name and you are there). If you are comparing an IB School to a non-IB School, email someone in the administration at the non-IB School and ask for: the overall graduation rate how many graduates are headed to 4-year schools the admissions criteria The answer to these questions are important, and if the IB coordinator/administrator is not willing to answer them, you should be wary of the school (Most likely, it means they are performing poorly in one or all of these categories). I am going to do a sample comparison between Pedro Menendez High School in St. Augustine, FL, and St. Petersburg School in St. Petersburg, FL, using the information I have: IB Diploma Rate, how long they have been an IB School, and IB Programme Admission Criteria. High School Pedro Menendez High School St. Peterburg School Diploma Rate 52% 90% IB Programme Started 2010 (First IB Graduating Class in 20) 1983 IB Programme Admissions Criteria Pre-IB classes in 9th and 10th grade in English, Spanish, Science, and Mathematics Writing sample Pre†requisite courses: Algebra 1 Honors Test scores: (public school students) READING: 6th or 7th grade FSA (Florida Assessment Test) score of 352 or higher AND MATH 6th grade FSA score of 347 or higher OR 7th grade FSA score of 347 or higher 6th 7th grade Final Academic Grades (math, science, social studies, English, world language) of A’s B’s. 8th grade Semester Academic Grades (subjects listed above) A’s B’s Students who do not meet the above testing or academic grades criteria may be placed in this group based on a common rubric that is used to calculate the percentage of criteria the student has demonstrated. At least 10% of the incoming 9th grade class will not meet all of the qualifications. Based on the information given, if my child or I met the qualifications for St. Petersburg High School, I would choose to attend their program given the fact that their IB programme is over 30 years old, and the IB Diploma Rate is so high. The school clearly knows the IB Programme well, and you or your child is much more likely to receive their IB Diploma if they attend this school. Receiving your IB Diploma will help you get college credit and save money down the road at your university. Read more about this in our other article, What is the IB Program? And What are IB Classes? Assessment and Management of Pain

Morphine is one of the prevalent analgesic opioid that is considered as potent and effective pain relievers and has been undertaken for past many years. This is used for undertaking both acute and chronic pain management. Morphine targets the pain due to myocardial infarction, surgery, injuries and others (Macintyre and Schug 2014). Morphine is an opiate drug that targets opioid receptors leading to the formation of the analgesia with the help of the mechanism of hyperpolarisation of interneuron and decrement in the release of the transmitters of pain. Human body consist of inbuilt analgesic and pain relieving system that regulates in the body by minimizing the sensations in the spinal cord that further transmits the sensations of the pain to different locations with the help of synapse within the neurons. Activation of the pain management in the spinal cord occurs by the supraspinal mechanism. This mechanism includes opioid system that is responsible for the release of endorphins, the adrenergic system that is responsible for the release of norepinephrine and serotogenic system that is responsible for the release of serotonin. Synergy and communication among all leads to the activation of analgesic activity. When the inbuilt analgesic system fails to control pain, additional analgesic drugs such as morphine is used to increase the working capacity of this inbuilt system. Besides this, morphine also regulates the generation of supraspinal structures leading to the activation of the whole system. Adrenergic drugs react with specific receptors for the production of the analgesia and morphine further reacts with these drugs for the regulation of the analgesia (Stang et al. 2014). Visceral pain targets the thoracic, abdominal and pelvic organs of the body and it is considered to be one of the most common types of the pain a doctor responds to. Visceral pain targets chest, prostate gland, pelvis, gastrointestinal tract, gall bladder, scrotum and vulva (Mayer et al. 2015). Surgical treatments available for the treatment of Angina pectoris and other chest pain is coronary artery bypass surgery or grafting and percutaneous coronary intervention that undertakes the change in the oxygen concentration in the body with the help of certain channel blockers such as nitrates and calcium. Alteration in the oxygen demand and supply leads to the reduction of the pain. Besides this, Cordotomy is another surgical procedure that is used for the treatment of visceral pain due to terminal maladies or illness such as cancer, AIDS, pulmonary fibrosis and many others. This surgery is undertaken percutaneously with the help of fluoroscopic or computerized tomography scan. The laminectomy surgery is undertaken in the spinothalamic tract under the presence of anaesthesia. Another technique that is appropriate as the surgical treatment for the visceral pain is myelotomy which are of two types Commissural and Punctuate or limited Midline. Commissural Myelotomy undertakes the m ultiscale laminectomy in the spinal cord. This targets the nerve fibre joining the brain with spinal cord and interrupts the pain there. While Punctuate or Limited Midline is a neuroablative surgery that undertakes the treatment of bladder, pancreas and colon by interrupting the center of dorsal column. This is one of the most effective methods as it can be used for the treatment of posterior columns of the organs (Lazzeri et al. 2015). Equity, Conscience and Things of Confidence and Fiduciary Obligation Essay

Equity, Conscience and Things of Confidence and Fiduciary Obligation Discuss - Essay Example It represents a clear delineation of information deemed as confidential as well the constituents of a brief of confidentiality. In a confidentiality agreement, there are typical requirements. Those requirements include not disclosing the items discussed as well as the scope and ramifications of discussions between the parties, not utilizing confidential information for any purpose other than is clearly delineated in the agreement, and not disclosing any information deemed as confidential to individuals or entities other than the employees or representatives of the recipient without the prior written consent. If employees or representatives of the recipient are granted access to confidential information, the party revealing the information should engage in a subsequent agreement binding the recipient to the same obligation as the original obligation of confidentiality. In addition to this, the original party remains responsible for the actions of those individuals who were provided wi th subsequent confidentiality agreement. Fiduciary obligation is defined as the legal duty of one party to look after the well being of another. Fiduciary obligation can apply to governments, corporations and individuals alike. By acting in the capacity of a fiduciary, a party is bounded to act ethically, responsibly and with the best interest of the appointee at hand. In so doing, a fiduciary obligation is subjected to breach and pertinent remedies when a breach takes place. The case of Canson Enterprises Ltd. v. Boughton & Co (1991) addresses a breach fiduciary obligation wherein Boughton & Company failed to disclose information on the secret profits obtained on a flip. This case dates back to May, 1977, wherein Cranso Enterpise Ltd. Entered into an agreement with Peregrine Ventures Inc. wherein it was agreed they would enter into a joint venture to purchase a piece of property and develop it.

See the instruction - Essay Example Basically, negligence can be described as the act of doing something a reasonable man would not do and a plaintiff must prove in such a case that the defendant owes a duty of care (Donoghue V. Stevenson, 1932). The factual problem is that W.R Grace and Riley Leather contaminated Woburn water supply site resulting sickness and death at Woburn. These companies have a duty care to protect environment while conducting the production activities. However, they breached their duty by disposing hazardous waste that led to death and illness among the citizens in this area. The death of 12 people of which 8 are kids can be attributed to approximate cause. These companies dumped barrels that contained TCE (Trichlorethylene) carcinogens onto the land and it sipped underground and contaminated the river which negatively affected the health of Woburn people since they use the river as their main source of water supply. For example, Anna Anderson’s son, Jimmy dies because of Leukemia and also another parent lost his son to the same disease on their way to the hospital. Moreover, one of the employees Palino developed lung cancer among other people who suffer from immune system diseases. These insta nces support the claim that W.R. Grace and Riley Leather acted in a negligent way since their action negatively impacted on Woburn people’s health. Besides negatively impacting on the health of people, W.R. Grace and Riley Leather also commit other legal case. For instance, they do not allow their employees to say the truth since they are given money or other benefits to remain silent. The workers risk losing their jobs if they reveal any information related to the dumping activities by these companies. For example, Al is afraid of becoming a whistleblower because he is afraid of losing his job. Additionally, Cheeseman gives him pressure after he reveals some facts about the

AIS integration with ECDIS and Radar Essay Example | Topics and Well Written Essays - 500 words

AIS integration with ECDIS and Radar - Essay Example The integration of AIS with 'Electronic chart display and information system' (ECDIS) has resulted in a revolution in the field of offshore marine communication. ECDIS, better known as 'Electronic nautical chart', is a name given to nautical chart representations on computers (Scheuermann, Wolf, 1996). However nautical chart representation is one of the aspects of ECDIS. ECDIS is a complete information system, providing all necessary information about whatever is displayed on the chart (Scheuermann, Wolf, 1996). Targets from the radar and from AIS can simultaneously be plotted on an electronic chart (Strenge, Rainer, & Bober, Stefan, 2004). Thus signals from both radar and AIS can be acquired and depending on the requirement, the information can be collected from either of the two sources or from both of them. The positioning of the target on the electronic chart is carried out by DGPS positioning system and in addition through radar map matching process that was developed by Stuttgart University (Strenge, Rainer, & Bober, Stefan, 2004). The ships have large electronic chart displays (ECDIS) installed on them on which AIS data and radar information from other ships is superimposed. These large displays have nowadays been replaced by small and portable computers. The port services have the responsibility to monitor the ship traffic.

International media, comparison essay Example | Topics and Well Written Essays - 1000 words

International media, comparison - Essay Example After all, what sells more than an unsolved mystery, an enigma, or a blatant lie? Do we watch, what we believe to be true in media, or what the media wants us to believe is true? But whatever the reason may be, we, as people tend to diligently follow the news that have the most deaths, the most warped up conspiracies with wronged parties; preferably an ambiguous wronged party. I chose an event that most of us are aware of because of the thorough coverage it has received in both countries: The Drone Attacks. The drones or unmanned aerial vehicles are aircrafts either controlled by pilots’ from the ground or increasingly, autonomously following a pre-programmed mission (Chris and Wright). The drones to Pakistan are controlled by the C.I.A - Central Intelligence Agency. The American intelligence works with the Pakistani intelligence, the I.S.I – Inter-Services Intelligence, to attack and defeat Al-Qaeda and Taliban militants that have taken refuge in Pakistan. This is all p art of America’s ‘War on Terrorism’ campaign of which Pakistan is an ally. Pakistan provides its own research on the habitation of these terrorists and US attacks them. The days and times, and the numbers of these missiles are unknown to Pakistan. This is so as to catch the terrorists unawares. There have been several successes and civilian casualties in this mission. A war against terrorism is obviously an important campaign. According to statistics, in 2011 alone, there were 6303 deaths from terrorist attacks in Pakistan, of which only 2800 were actual terrorists (South Asia Terrorism Portal), the rest just innocent victims. In the US, 30 deaths have been from terrorism since 9/11 2001 (Global Terrorism Database). The difference is magnificent; however, it is mainly the South Asian countries that suffer most from this epidemic. Yet loss of life anywhere is a situation that is to be rued. Therefore, as one of the superpowers of the world, US took upon itself to fight this growing epidemic. Pakistan allied herself with the US. Since the last two years, C.I.A has led its own covert operations giving them information to the refuge places of the Taliban and Al-Qaeda in Pakistan. However, there are many conspiracies surrounding these attacks, just as it is with any Intelligence mission. It is claimed that while Pakistan officials are working with C.I.A privately, they publicly condemn the loss of civilian lives. Then the lack of information to the Pakistani public is causing them to see these attacks in a suspicious light, necessitating it for the US diplomats to come to Pakistan repeatedly for briefings and meetings. The operation has to be covert as well, because if the situation is made public, then the terrorists will be informed. The two main problems here are that a) C.I.A is not including Pakistan enough in its operations, and Pakistani government not informing the general public of its involvement but in fact, antagonizing them further against America. These obvious conflicting stories in both countries need to be dealt with so that the masses can trust these operations, and the number of Drone attacks reduced as they have increased in a surprising number in the last two years causing several innocent people to die. I decided to choose the high circulated newspapers of both the countries to get a perspective into each newspaper’s representation of this ongoing event. From US, I chose the New York Times. Scmitt describes the censure arising

It is a broad observation that modern day buildings are more susceptible to maintenance as compared to older counterparts. This research investigates of the impact of design defects on maintenance through their barriers and limitations of the interaction between them in an attempt to improve building design to reduce maintenance costs, especially in hospital buildings. In addition to literature studies, the interviewee questions and a case study have been analyzed to identify design and maintenance defects, their impacts on the maintenance and management of hospital buildings in Saudi Arabia. Furthermore, it explores the concerning roles, responsibilities, obligations, and liabilities of the agents who are involved in the design and maintenance performance and feasible solutions. The King Fahad Hospital was chosen for the stud y and the five interviewees were interviewed on telephone. Qualitative methodology was selected to collect data for this study; it has been found out that the majority of maintenance dilemmas in the hospital building are attributed to design defects. The defects affecting the maintenance of hospital in the budget were led to depletion of maintenance budget besides an increase in maintenance costs. Some recommendations were provided. Conclusion The first topic the chapter reviewed was maintenance. Common problems were identified and approaches to reduce the burden of maintenance through Total Quality Management of design were described. The effect poor design has on society was explored in terms of political, economic, social, technological, environmental, and legal aspects. The chapter discussed design defects in terms of the professional obligations that each agent in the design team holds. The chapter emphasized the roles, which the civil engineers, the architects, the interior de signers, the commissioning agents, and the structural engineers have in the designing process. It also talked about the increasing role of legal action in poor design. Then the chapter discussed the inherent limitations of the building design and maintenance and its limitation in their relation. It lists the scope of the projects as well as the objectives and concludes with the significance of an investigation of the impact of design on the maintenance of hospital buildings in Saudi Arabia. This presents an opportunity for investigations of the impact of design imperfections on maintenance. In prior knowledge of most results and the factors that influenced the maintenance of negligence in design, circles many aspects such as specification of materials, thermal movement, wet areas, ventilation, inefficient detailing, improper material selection and poor design for accessing maintenance measures. The chapter also argued that the design process must also be considered from legal standp oint and the obligations of the design agents. There is mention in the literature of maintenance issues in Saudi Arabia. Ikhwan and Burney (1999) pointed out the importance of maintenance in the Kingdom, and discussed the need for maintenance education. They also highlighted research activities on maintenance performed at King Abdulaziz University in Jeddah.
